{"id":7398,"date":"2013-12-09T16:48:01","date_gmt":"2013-12-09T16:48:01","guid":{"rendered":"http:\/\/www.techiteens.com\/review\/federal-audit-targets-suny-systems-title-ix-compliance-8\/"},"modified":"2013-12-09T16:48:01","modified_gmt":"2013-12-09T16:48:01","slug":"federal-audit-targets-suny-systems-title-ix-compliance-8","status":"publish","type":"post","link":"https:\/\/www.techiteens.com\/review\/federal-audit-targets-suny-systems-title-ix-compliance-8\/","title":{"rendered":"Federal audit targets SUNY system\u2019s Title IX compliance"},"content":{"rendered":"<div id=\"post-1750\">\n<p>By Lauren Mineau<br \/>Editor-in-Chief<br \/>asp_online@hotmail.com<\/p>\n<p>The U.S. Department of Education<br \/>Office for Civil Rights<br \/>announced a resolution agreement<br \/>with SUNY on Thursday<br \/>Oct. 31. that ends a multi-year<br \/>review of University at Albany,<br \/>SUNY Buffalo State, Morrisville<br \/>State College and SUNY New<br \/>Paltz. The probe considered 159<br \/>complaints of sexual violence<br \/>from the 2007-2008 academic<br \/>year to 2010-2011.<br \/>The SUNY system was chosen<br \/>because it is the largest public<br \/>higher education system in the<br \/>United States with 64 campuses<br \/>across all parts of New York.<br \/>SUNY was not necessarily<br \/>chosen because of any known<br \/>problems but rather because of<br \/>its size and diversity. The review<br \/>found SUNY opposing the<br \/>gender equality law, Title IX. A<br \/>voluntary resolution agreement<br \/>will include changes to the way<br \/>campuses handle sexual violence<br \/>complaints.<br \/>UAlbany was chosen as one<br \/>of the schools to receive an indepth<br \/>review but no complaints<br \/>were made to the Office of Civil<br \/>Rights (OCR) about UAlbany<br \/>specifically.<br \/>On April 4, 2011 the OCR issued<br \/>the \u201cDear Colleague\u201d letter<br \/>to all colleges and universities in<br \/>the U.S. For the first time, OCR<br \/>addressed that sex discrimination<br \/>must include all forms of sexual<br \/>violence (rape, sexual harassment,<br \/>relationship violence etc.).<br \/>Previously, Title IX covered<br \/>gender discrimination in<br \/>education as far as providing<br \/>equal athletics scholarships for<br \/>men and women, admission<br \/>to schools and other forms of<br \/>exclusion based solely on gender.<br \/>Essentially, it provided equality<br \/>between men and women and<br \/>was enacted in 1972.<br \/>Under the new initiative,<br \/>UAlbany did make immediate<br \/>changes to comply with the new<br \/>guidance.<br \/>Prior to the \u201cDear Colleague\u201d<br \/>letter being issued the SUNY<br \/>system, including UAlbany was<br \/>already in the midst of the OCR<br \/>audit. UAlbany\u2019s audit included<br \/>a thorough review of 59 reported<br \/>cases of sexual violence recorded<br \/>between 2005 and 2010. The<br \/>audit began in January 2011 and<br \/>concluded in September 2013.<br \/>Those 59 cases that were<br \/>audited all occurred prior to the<br \/>\u201cDear Colleague\u201d letter being<br \/>issued.<br \/>\u201cWe were not chosen to be<br \/>audited because something was<br \/>wrong, we were not cited for<br \/>any problems either. SUNY was<br \/>chosen as a large representative<br \/>sample of higher education,\u201d said<br \/>Karl Luntta, UAlbany spokesman.<br \/>UAlbany does have a Title IX<br \/>coordinator, Dr. Tamra Minor,<br \/>in the Office of Diversity and<br \/>Inclusion, located in University<br \/>Hall. Currently, she handles<br \/>monitoring and evaluating policy<br \/>and procedures that respond to<br \/>complaints of sex discrimination,<br \/>including sexual harassment and<br \/>sexual assault and ensures all<br \/>students have equal educational<br \/>opportunity. Minor also investigates<br \/>if there is a complaint<br \/>against the procedures followed<br \/>in a case of this nature.<br \/>Luntta said the voluntary<br \/>agreement from the OCR will<br \/>help support programs UAlbany<br \/>already has in place.<br \/>\u201cOur goal is always to provide<br \/>the safest and most supportive<br \/>community for our students,\u201d he<br \/>said.<br \/>Going forward, UAlbany will<br \/>open an Advocacy Center for<br \/>Sexual Violence in Spring 2014.<br \/>The office will have a staff that<br \/>will help students with issues of<br \/>sexual violence, act as advocates<br \/>during hearings and provide any<br \/>support for the entire campus<br \/>community. The center will also<br \/>improve UAlbany\u2019s response to<br \/>sexual issues across the entire<br \/>campus.<br \/>The center will consolidate all<br \/>the aspects that may be involved<br \/>in a case of sexual violence, discrimination<br \/>etc.. In some cases,<br \/>multiple facets can be involved<br \/>and the center will provide a<br \/>central location to report, assess<br \/>and monitor the information. For<br \/>example, if a student is reporting<br \/>a case, University Police, Residential<br \/>Life, Student Success and<br \/>other offices may be involved in<br \/>one single situation. The Advocacy<br \/>center will provide a central<br \/>location for all the information.<br \/>\u201cThe University at Albany has<br \/>many mechanisms in place to<br \/>support all forms of sex discrimination.<br \/>The agreement with<br \/>OCR confirms that UAlbany<br \/>has been proactive in addressing<br \/>this issue and also reminds our<br \/>community of the importance of<br \/>developing even more resources<br \/>to assist and support victims of<br \/>sexual or relationship violence. It<br \/>is our responsibility as a University<br \/>\u2013 and by that I mean all of<br \/>us \u2013 faculty, staff and students to<br \/>provide the safest and most supportive<br \/>environment possible for<br \/>the entire campus community. To<br \/>do that, we must not only support<br \/>victims of sexual violence, but<br \/>take positive steps to educate<br \/>our community on this issue. We<br \/>must also work to address the<br \/>societal culture that contributes<br \/>to sexual violence,\u201d said Christine<br \/>Bouchard, Vice President for<br \/>Student Success.<br \/>In addition to the Advocacy<br \/>Center opening, the Title IX coordinator<br \/>will now be informed<br \/>of every case of sexual violence<br \/>on campus and more Title IX<br \/>training will occur across campus.<br \/>Similar to Safe Space training,<br \/>it will allow other people on<br \/>campus to serve as advocates.<br \/>Project SHAPE, a peer education<br \/>program that focuses on sexuality<br \/>and sexual health promotion<br \/>will also be involved with the<br \/>center opens.<br \/>The Student Code of Conduct<br \/>now allows both parties in cases<br \/>of sexual violence to go through<br \/>the appeal process.<br \/>\u201cThis center is a real achievement<br \/>with today\u2019s budget cuts<br \/>and it is a real credit to President<br \/>Jones,\u201d Bouchard said.
